Healthy Lumberjack
Terms of Service
Effective date: January 10, 2025
These Terms of Service ("Terms") govern your access to and use of Healthy Lumberjack's virtual nutrition and dietetic services throughout Canada. By creating an account, booking an appointment, or submitting an intake form, you agree to these Terms and all applicable provincial and federal regulations.
1. Eligibility
You must be at least 18 years old and capable of consenting to health services in your province of residence. Services are available to Canadian residents only. You agree to provide accurate, current, and complete information during intake and to update it as needed.
2. Nature of Services
Healthy Lumberjack connects you with registered dietitians and nutritionists who comply with provincial regulatory college standards. Services delivered through our platform are for nutrition counselling and wellness support and are not a substitute for emergency medical care. If you require urgent assistance, call 911 or seek emergency services immediately.
3. Fees and Insurance
Healthy Lumberjack verifies your benefits coverage and bills insurers directly whenever possible. We do not require upfront payment or provide routine fee schedules; instead, we coordinate with your insurer on your behalf. While we work with carriers to confirm eligibility in advance, insurer approval is not guaranteed. If a claim is denied or only partially covered, we will contact you to arrange payment and you remain responsible for any remaining balance.
4. Client Responsibilities
You agree to participate in appointments in a distraction-free environment, follow care recommendations as feasible, promptly notify us of cancellations or schedule changes, and maintain the privacy of virtual session links and communications. You are responsible for any equipment, internet connectivity, or software required to access our services.
5. Privacy and Confidentiality
Your personal information is handled in accordance with our Privacy Policy and applicable Canadian privacy laws, including PIPEDA and provincial health privacy statutes. By using our services you consent to those practices.
6. Intellectual Property
All content on this site, including educational materials, branding, and interface design, is owned by Healthy Lumberjack or our licensors. You may use materials for personal, non-commercial purposes only. You may not reuse or distribute content without written permission.
7. Limitation of Liability
To the fullest extent permitted by Canadian law, Healthy Lumberjack, its directors, clinicians, and staff are not liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the fees you paid for services in the six months preceding the claim.
8. Cancellation and Refunds
Appointments may be rescheduled or cancelled with at least 24 hours notice. Late cancellations or missed appointments may be charged up to the full session fee. Refund requests are reviewed on a case-by-case basis in accordance with provincial consumer protection laws.
9. Termination
We may suspend or terminate access if you breach these Terms, engage in abusive behaviour, or misuse the platform. You may discontinue services at any time by notifying us. Termination does not limit our right to recover unpaid fees.
10. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes will be subject to the exclusive jurisdiction of the courts in Toronto, Ontario, unless otherwise required by applicable consumer protection statutes.
11. Changes to These Terms
We may update these Terms to reflect changes in regulation or services. Material changes will be posted with at least 14 days notice. Continued use after the effective date signifies acceptance of the revised Terms.
